Licences & Permits
What You Need to Operate Legally

Operating without required licences or permits can result in fines, forced closure, and personal liability. Requirements vary enormously by business type, industry, location, and size — and they exist at federal, state, county, and city levels. There is no single list that applies to every business. The right starting point is to check each level systematically.

How do I know which licences I need?

There is no single answer — it depends on your business type, industry, and location. The SBA's licence finder at sba.gov is the best starting point. Work through each level: (1) Federal — check if your industry is federally regulated. (2) State — most states require a general business registration plus industry-specific licences for professions like healthcare, construction, legal, and financial services. (3) Local — cities and counties often require additional permits for signage, zoning, health, fire safety, and more. When in doubt, contact your local Small Business Development Center (SBDC) — they are free.

What happens if I operate without a required licence?

Consequences vary by jurisdiction and licence type but can include: fines and back fees, forced closure until licenced, criminal penalties in some cases, voiding of contracts entered into while unlicenced, and invalidation of certain insurance claims. In some professional fields, operating without a licence is a misdemeanor or felony. Start with the SBA and your state portal to identify requirements before operating, not after.

I work from home — do I need any licences or permits?

Possibly yes. Even home-based businesses may need: a general business licence, a home occupation permit from your local government, and compliance with local zoning ordinances that restrict certain business activities in residential areas. Some homeowner association (HOA) rules also restrict commercial activity. Check with your city or county planning or zoning office. The SBA's licence finder includes home-based business considerations.
